By accessing or using FlashMarket ("the platform", "we", "us"), you agree to be bound by these Terms of Use. If you do not agree, please do not use FlashMarket. We reserve the right to update these terms at any time. Continued use of the platform constitutes acceptance of any changes.
2. Eligibility
You must be at least 18 years old to create an account or post listings on FlashMarket. By using the platform, you confirm that you meet this requirement. We reserve the right to suspend or terminate accounts that we believe belong to minors.
3. Account responsibilities
- You are responsible for maintaining the confidentiality of your account credentials.
- You must provide accurate and truthful information when registering and posting ads.
- You must not share your account with others or create multiple accounts.
- You must notify us immediately if you suspect unauthorised access to your account.
4. Listing rules
All listings must comply with the following rules:
- Listings must accurately describe the item or service being offered.
- Photos must be of the actual item — stock images or images stolen from other listings are not permitted.
- Prices must be in New Zealand dollars (NZD).
- All listings are subject to review and approval before going live.
5. Prohibited content
The following are strictly prohibited on FlashMarket:
- Illegal items or services (including controlled substances, weapons, counterfeit goods)
- Adult or sexually explicit content
- Fraudulent, misleading, or deceptive listings
- Hate speech, harassment, or content that discriminates based on race, gender, religion, or other protected characteristics
- Personal information of third parties without their consent
- Pyramid schemes, multi-level marketing, or other fraudulent schemes
- Live animals (with exceptions for legitimate pet rehoming)
We reserve the right to remove any listing that violates these rules without notice.
6. Transactions and payments
FlashMarket is a platform that connects buyers and sellers. We are not a party to any transaction between users. We do not handle payments, hold funds, or provide any form of buyer or seller protection. All transactions are conducted directly between users at their own risk. We strongly recommend following our Safety Tips for all transactions.
7. User conduct
When using FlashMarket, you agree not to:
- Harass, threaten, or intimidate other users
- Attempt to circumvent our verification or moderation systems
- Use automated tools to scrape, crawl, or mass-post listings
- Interfere with the technical operation of the platform
- Attempt to access other users' accounts or data
8. Intellectual property
By posting content on FlashMarket (including photos, descriptions, and other materials), you grant us a non-exclusive, royalty-free licence to display, reproduce, and distribute that content for the purpose of operating the platform. You retain ownership of your content. You must not post content that infringes the intellectual property rights of others.
9. Disclaimers
FlashMarket is provided "as is" without warranties of any kind. We do not verify the accuracy of listings or the identity of users beyond our verification process. We are not responsible for the quality, safety, legality, or availability of items listed on the platform.
10. Limitation of liability
To the maximum extent permitted by New Zealand law, FlashMarket shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the platform, including but not limited to losses arising from transactions, scams, or reliance on listing information.
11. Termination
We reserve the right to suspend or permanently terminate your account at any time, with or without notice, for violations of these Terms of Use or for any other reason at our discretion. You may also delete your account at any time by contacting us.
12. Governing law
These Terms of Use are governed by the laws of New Zealand. Any disputes arising from your use of FlashMarket shall be subject to the exclusive jurisdiction of the New Zealand courts.
